Get
Your Money Back!
If
you’ve been scammed by these crooks, don’t let them get away with it.
If
you’ve had any dealings with them whatsoever, even if you don’t think you’ve
been scammed, it’s still very likely that they were in violation of numerous
laws and that you can recover some, if not all of your losses.
The most important result of the FTC investigation is the fact that you can now fight these crooks on your own turf. You don’t have to go to Massachusetts to fight back!
Before
you start, be sure to read all of the Settlement
Questions and Answers on the FTC web-site to determine just where you
stand. Everyone’s situation is different.
First
off, I want you to understand that I am not a lawyer, and that I recommend that
you consult a lawyer about your situation. However, if you determine for any
reason not to get a lawyer, you still have the option of your local “small
claims court” ( see NOTE below*). The process is
usually very simple and your local “clerk of the court” will explain the
entire process to you. You don’t need a lawyer and the fee is usually very
low. The fee in Alabama is only $30 and if you win, the defendant (Leasecomm/Microfinancial)
will have to pay that. Be sure to ask what the maximum limit is (they’ll
probably tell you anyway).
Don’t
be afraid, most small claims judges conduct the proceedings in a very informal
atmosphere and will guide you (sort of acting as your lawyer), especially if
LC/MFI has a sharp lawyer representing them.
Sit
down and put on paper the entire account of your dealings with Leasecomm/MFI in
chronological order to the best of your memory.
Be
sure to have all your documentation with you including a copy of the Stipulated
Final Judgment, and be
truthful. Additional information such as a copy of;
Criminal
Methods (modus operandi) and
The
Big Lie may
also be helpful. The more ammo you have the better.
If
you expect to collect damages (more than they actually “stole”), such as
losses resulting from bad credit reports submitted by MFI, then you don’t want
to go the “small claims” route. GET A LAWYER.
The
“Useful Links “ on this site lists several
active class action attorneys that may be of help.
I recommend that you attempt to contact them by phone because they are
very busy and may not be able to promptly answer emails.
Your
next option would be to consult a local attorney or you can always get proper
guidance from your local district attorney, commonwealth attorney, or even your
State Attorney General. Don’t be afraid to ask questions!
Armed
with a copy of the Stipulated
Final Judgment you
should have no trouble getting your money!
*NOTE; If
your local small claims court doesn't allow claims against out of state
entities, then immediately contact your States
Attorneys General
